ELECTRONIC DIGITAL SIGNATURE
LAWS ON EDS
Kazakhstan adopted the Law “On electronic document and electronic digital signature” in 2003 (hereinafter – the Law on EDS).
Kazakhstan Civil Code allows companies to make contracts in electronic form, including through the exchange of documents.
Section 7 of the Law on EDS says that a signed document through an EDS is equivalent to a signed document on paper.
Although the legislation of Kazakhstan permits to sign documents through EDS, many companies in Kazakhstan still exchange paper versions in a traditional way.
WHAT CAN BE SIGNED THROUGH EDS
Through EDS, you can sign any documents, including but not limited to, all accounting closing and primary documents, acts of acceptance of work, power of attorney for receiving goods, invoices, bills, any contracts, agreements.
ADVANTAGES OF EDS
By signing documents such as an act of acceptance of work through EDS, companies will get the following advantages:
• it reduces the expenses on the delivery of documents, couriers, drivers and postage which unloads the city from traffic jams and cuts the emission of pollutants into the atmosphere;
• it enables to access the digital version of documents quickly without delay and have them always on your hands;
• it reduces paper storage space, consequently less paperwork.
RECOMMENDATIONS
We recommend companies switching to an electronic format of documents as it is very convenient. Today some public procurement contracts are already signed through digital signatures and companies issue electronic invoices, make payments through online banking.
We suppose that in the near future companies will also switch to electronic labor contracts.
