New fines for employers for breaches related to the employment agreement registration system on www.enbek.kz
The obligation of Employers to submit information on employment agreements has already been stipulated under the Kazakhstan employment law. However, failure to comply with this obligation will now entail administrative liability.
The amendments affect Employers’ use of the portal Enbek.kz (further – the Portal).
In this regard, amendments have been introduced to the Administrative Offences law, which will enter into force on 12 March 2026.
What constitutes a breach?
The following actions constitute breaches:
- failure to submit or late submission of information on employment agreements to the Portal within the prescribed time limits;
- submission of incomplete information on employment agreements to the Portal;
- submission of inaccurate information on employment agreements to the Portal.
Time limits for submission of information to the Portal
- Conclusion of a new employment agreement – within 5 business days from the date of conclusion;
- Termination of an employment agreement – within 3 business days from the date of termination;
- Information on amendments or supplements to an employment agreement – within 15 calendar days;
- Information on the extension of an employment agreement – within 15 business days.
If the Employer identifies errors after submitting the information, such errors may be corrected, or the submitted information may be deleted within 30 business days from the date of the initial submission.

Authorities
Pursuant to Article 693 of the Administrative Offences law, such breaches will be reviewed and imposed by state employment inspectors.
Recommendations for Employers
Employers are advised to:
- ensure timely submission of information on employment agreements to the Portal;
- regularly verify the accuracy and completeness of the submitted information;
Appoint a responsible person (e.g., an HR specialist or other employee) responsible for maintaining the employment agreement registration system. The Employer should issue an internal order appointing such a responsible person
