Construction activities in Kazakhstan

Any construction activities are seriously regulated in Kazakhstan and involve a number of permits and approvals from the authorized governmental bodies. The construction industry is under reforms in the light of targeting the green economy.
The principal legislative act regulating the area of construction is the Construction Act. Most of the stages related to the process of construction are subject to coordination and approval from the authorized governmental bodies. The main stages are:

  1.  Obtaining the land plot and permit for construction on the land plot;
  2.  Obtaining technical conditions for public utilities;
  3.  Approval and State expertise of construction design;
  4.  Obtaining construction permit;
  5.  State supervision during the process of construction; and
  6.  Final State acceptance and property right registration;

Administrative liability may result from noncompliance with requirements relating to the approval and coordination of the construction process with state authorities.

Most types of construction activities are subject to mandatory licensing in Kazakhstan. The Licensing Act provides a detailed list of construction activities subject to licensing. Activities range from the drafting of architectural plans and blueprints to the construction, repair, alteration, and modernization of buildings and installations.

A company must comply with certain qualification requirements set forth in the Construction Licensing Rules to obtain such a license. The compliance with qualification requirements shall be confirmed by the license holder on a regular basis by submitting the respective reports to state authorities.

Licenses are obtained from local executive bodies. An individual or a company may apply for and obtain a license which covers one or a number of activities requiring licenses. The individual or legal entity may be issued with a license for an unlimited term. In case the company holding a construction license breaches Kazakhstani law, the license may be suspended or revoked.
